2. Subscription Cancellation

2.1 How to Cancel

You can cancel your subscription at any time through:

  • Your account settings: Go to Billing → Cancel Subscription
  • Stripe Customer Portal: Access via the billing page
  • Email request: Contact us at [email protected]

2.2 When Cancellation Takes Effect

When you cancel your subscription:

  • Immediate effect: Your subscription will not renew at the end of the current billing period
  • Continued access: You retain full access to your subscription features until the end of your paid period
  • Credits retained: All remaining credits stay in your account and can be used until expiration
  • No automatic renewal: You will not be charged again unless you reactivate your subscription

Example:

If you subscribe on January 1st and cancel on January 15th, your subscription remains active until February 1st. You will not be charged on February 1st, and your subscription will end at that time.

3. Refund Policy

3.1 General Refund Policy

Except as required by law or specified below, all payments are non-refundable. We do not provide refunds for:

  • Partial billing periods (monthly subscriptions)
  • Unused subscription credits at the time of cancellation
  • Changes in your usage needs or business circumstances
  • Credits consumed through generation services
  • Dissatisfaction with AI-generated results (due to the subjective nature of creative output)

3.2 When Refunds May Be Issued

We may issue refunds in the following exceptional circumstances:

  • Technical errors: If you were charged incorrectly due to a technical error on our part
  • Duplicate charges: If you were accidentally charged multiple times for the same service
  • Service unavailability: If our service was unavailable for an extended period due to our fault
  • Unauthorized charges: If charges were made without your authorization

3.3 How to Request a Refund

4. EU Right of Withdrawal (14-Day Cooling-Off Period)

If you are a consumer located in the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason, in accordance with the EU Consumer Rights Directive (2011/83/EU).

4.1 Withdrawal Period

The withdrawal period is 14 days from:

  • Subscriptions: The date you first subscribed to the service
  • One-time purchases: The date you completed the purchase

4.2 How to Exercise Your Right of Withdrawal

4.3 Effects of Withdrawal

If you withdraw from your purchase within the 14-day period:

  • We will refund all payments received from you
  • The refund will be processed within 14 days of receiving your withdrawal notice
  • The refund will be made using the same payment method you used for the original transaction

4.4 Loss of Right of Withdrawal

Your right of withdrawal may be lost if:

  • Service fully performed: You have expressly requested that we begin providing the service during the withdrawal period and the service has been fully performed
  • Digital content consumed: You have used credits to generate images or videos (digital content that has been delivered and consumed)

Note:

By subscribing to Fluxion and using the service (generating images or videos), you expressly request that we begin performance during the 14-day withdrawal period. If you use the service during this period, your right of withdrawal may be affected.

5. One-Time Credit Purchases

5.1 Non-Refundable Once Added

One-time credit purchases are non-refundable once the credits have been added to your account. This is because:

  • Credits are immediately available for use upon purchase
  • Credits never expire and provide permanent value
  • They constitute digital content that has been delivered

5.2 EU Consumer Rights Exception

EU consumers have a 14-day right of withdrawal for credit purchases, but this right is lost if:

  • You have used any of the purchased credits to generate content
  • You have expressly consented to immediate delivery and acknowledged the loss of withdrawal right

6. Plan Changes (Upgrades & Downgrades)

6.1 Upgrades

When you upgrade to a higher-tier plan:

  • Immediate effect: You are charged the prorated difference immediately
  • New credits granted: You receive the new plan's monthly credits immediately
  • No refund: No refund is provided for the unused portion of your previous plan

6.2 Downgrades

When you downgrade to a lower-tier plan:

  • Scheduled for next period: The downgrade takes effect at the end of your current billing period
  • Current benefits retained: You keep your current plan benefits until the period ends
  • No refund: No partial refund is provided for the current period

7. Payment Failures & Retries

If a subscription payment fails:

  • We will attempt to process the payment again automatically
  • You will receive email notifications about the failed payment
  • Your subscription may be suspended or canceled if payment continues to fail
  • You can update your payment method through the billing page

If your subscription is canceled due to payment failure, you will not be charged for any period during which the service was not available to you.

8. Chargebacks & Payment Disputes

If you dispute a charge with your bank or credit card company:

  • Contact us first: We strongly encourage you to contact us directly before initiating a chargeback
  • Account suspension: Your account may be suspended during chargeback investigation
  • Service termination: Fraudulent chargebacks may result in permanent account termination
  • Resolution: We will work with you and the payment processor to resolve legitimate disputes

⚠️ Warning

Initiating a chargeback without first contacting us may result in the immediate suspension of your account and loss of access to all purchased credits and generated content.

9. Refund Processing Time

When a refund is approved:

  • Processing time: Refunds are processed within 5-10 business days of approval
  • Payment method: Refunds are issued to the original payment method
  • Bank processing: It may take an additional 5-10 business days for the refund to appear in your account, depending on your bank or card issuer
  • Confirmation: You will receive an email confirmation when the refund is processed
